The cabinet has approved amendment which includes court to reduce or abolish waiting period of 6 months for divorce through mutual consent. The Cabinet as also accepted the proposal of the Parliamentary Standing Committee on Law and Justice that in case of a divorce, the women must have a share in the husband’s property. However, the amount of share will be determined by the courts on case by case basis.

The Marriage Laws (Amendment) Bill also seeks to give rights to adopted children which it treats at par with the biological-off springs of parents seeking divorce. It is to be noted that the bill was introduced in the Rajya Sabha a couple of years ago, from where it was referred to the Parliamentary Standing Committee on Law and Justice and Personnel. Earlier, the Parliamentary panel to define irreversible breakdown of marriage in the Special Marriages Act and Hindu Marriages Act. Under the new law, a woman can oppose against divorce on grounds of financial hardships and property obtained after marriage has to be dispersed evenly among the husband and wife.
